Our platform, including all software, designs, text, graphics, and AI models, is owned by Ekan Limited and protected by intellectual property laws. You may not copy, modify, or create derivative works without our express written permission.

5. Prohibited Uses

You agree not to use our services to:

6. Subscription Plans and Payment

Subscription Tiers

We offer multiple subscription plans with different features and usage limits:

• Free Plan: Limited access with 10 lifetime onboarding generations
• Pro Plan: Monthly or annual subscription with enhanced features and higher usage limits

Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis
• Payments are processed securely through Stripe
• All fees are non-refundable except as specified in our Refund Policy
• We reserve the right to change pricing with 30 days' notice to existing subscribers
• Failure to pay may result in suspension or termination of your account

7. Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free operation of our services
• That all features will always be available or function as expected
• That our services will meet all your specific requirements

We reserve the right to:

• Modify, suspend, or discontinue features or services at any time
• Perform maintenance that may temporarily interrupt service
• Update our platform with new features or improvements
• Change pricing with appropriate notice to subscribers

8. Disclaimer of Warranties

You acknowledge that AI-generated content may require review and editing, and you are responsible for ensuring the accuracy and appropriateness of content created using our services.

9. Limitation of Liability

To the maximum extent permitted by law, Ekan Limited and its affiliates shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use our services
• Damages resulting from unauthorized access to or alteration of your content
• Service interruptions, delays, or failures beyond our reasonable control
• Third-party actions or content

10. Termination

Termination by You

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation will take effect at the end of your current billing period, and you will retain access until that time.

Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms of Service
• You engage in fraudulent, abusive, or illegal activity
• You fail to pay subscription fees when due
• We are required to do so by law
• We discontinue the service (with appropriate notice)

Data Retention After Termination

Upon termination, your right to use our services will cease immediately. Your data will be handled as follows:

• 30-Day Grace Period: Your content remains accessible for 30 days after termination or cancellation
• After 30 Days: All user-generated content, templates, and onboarding data are permanently deleted from our systems
• Transaction Records: Billing and transaction records are retained as required by law for accounting and tax purposes (typically 7 years)
• Account Data: Basic account information may be retained to prevent fraud and enforce our terms

11. Indemnification

You agree to indemnify, defend, and hold harmless Ekan Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Content you create, publish, or distribute using our services
• Your violation of these Terms of Service
• Your violation of any rights of another party

12. Dispute Resolution

Informal Resolution

Before filing a formal claim or initiating arbitration, you agree to contact us to attempt to resolve the dispute informally. We will work in good faith to resolve any issues you may have within 30 days of receiving your notice.

Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong for resolution of any disputes.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by:
